1. Definitions

Below is a list of definitions for terms used in this Privacy Policy:

• Site refers to HighSyntax, the website and platform for purchasing the Estate Agent Protocol, accessible at highsyntax.com.
• Asset refers to the Estate Agent Protocol, a downloadable digital zip file containing proprietary prompt logic, license and instructional materials.
• Personal Data refers to data about a living individual who can be identified from those data (limited to email addresses and payment-related information in our case).
• Usage Data refers to data collected automatically, either generated by the use of the Site or from Site infrastructure itself (e.g., page views, device type, geographic region).
• Cookies refers to small files stored on your device, which may be used for essential functionality and analytics.
• Data Controller refers to HighSyntax, which determines the purposes for which and the manner in which any Personal Data are processed.
• Data Processors (or Service Providers) refers to any natural or legal person who processes data on behalf of the Data Controller, such as the Payment Processor and Email Service Provider.
• Data Subject refers to any living individual who is the subject of Personal Data.
• User or Customer refers to any person or entity using the Site or purchasing the Asset. The User corresponds to the Data Subject, who is the subject of Personal Data.
• Payment Processor refers to Stripe, the third-party service processing payments for Asset purchases.
• Email Service Provider refers to any third-party service we use to send transactional emails (e.g., purchase confirmations, download links).

2. Information Collection and Use

We collect minimal information for specific purposes to facilitate Asset purchases and improve the Site.

2.1. Personal Data

When you purchase the Asset, we collect the following Personal Data:

• Email Address: Required to send your purchase confirmation the Asset. This is the sole personally identifiable information we directly collect and store.
• Payment Information: Processed securely by our Payment Processor (Stripe). We do not store credit card numbers, billing addresses, or full payment details on our servers. Stripe collects this information to process transactions and may retain it according to their privacy policy.

2.2. Usage Data

We collect anonymous usage information through privacy-focused analytics to improve the Site:

• Browser type and version
• Geographic region (non-specific, country/state level)
• Pages visited within the Site
• Time spent on the Site
• Referral source (how you arrived at the Site)

This data is anonymized and aggregated. The data is collected via privacy-focused, cookie-less analytics tools and cannot be used to identify individual users. The collected data is used solely to enhance Site functionality and user experience.

2.3. Cookies

HighSyntax does not use cookies, trackers, or persistent local storage to monitor your behavior. We believe in a frictionless, private browsing experience.

• No Analytics Cookies: We do not store files on your device to track your session history.
• No Advertising Pixels: We do not use Facebook Pixels, Google Ads tracking, or retargeting cookies.
• Session Handling: Any temporary data required for the checkout process is handled securely by our payment processor (Stripe) solely during the transaction window and is not stored by HighSyntax.

3. Use of Data

HighSyntax uses the collected data for these specific purposes:

• Transaction Processing: To process your Asset purchase, verify payment, and generate your license.
• Product Delivery: To send you the Asset file via email.
• Customer Support: To respond to inquiries, technical issues, or disputes related to your purchase.
• Legal Compliance: To maintain records as required by Hong Kong SAR tax and commercial law.
• Site Improvement: To analyze anonymized Usage Data for improving user experience, identifying technical issues, and optimizing Site performance.

We do not use your Personal Data for:

• Marketing or promotional emails (unless you explicitly opt-in)
• Selling or sharing with third parties for their marketing purposes
• Tracking individual behavior across other websites

4. Retention of Data

We retain your Personal Data only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, including compliance with legal obligations, dispute resolution, and enforcement of our Terms. Specifically:

• Email Addresses: Retained indefinitely to maintain records of license ownership and provide customer support. You may request deletion at any time (see Section 7), though we may retain certain information as legally required for tax and commercial record-keeping (typically 7 years in Hong Kong SAR).
• Payment Transaction Records: Retained by Stripe according to their retention policies and legal requirements. We retain minimal transaction metadata (purchase date, amount, transaction ID) for up to 7 years for accounting and dispute resolution purposes.
• User Data: Anonymized analytics data is retained for up to 24 months for trend analysis and Site improvement, unless used to strengthen security or improve functionality, in which case it may be retained longer.

Important Note: Once you download the Asset, we cannot "recall" or delete the files from your devices. Data retention policies apply only to information stored on our servers.

5. Transfer of Data

Your Personal Data, including email addresses and payment information, may be transferred to and maintained on computers located outside your country or jurisdiction where data protection laws may differ, particularly when processed by our Payment Processor (Stripe) or Email Service Provider. By using the Site and agreeing to this Privacy Policy, you consent to this transfer.

HighSyntax takes reasonable steps to ensure that your data is treated securely and in accordance with this Privacy Policy. No transfer of your Personal Data will occur to an organization or country without adequate controls, including the security of your data, as stipulated by applicable laws such as GDPR (for EU customers) and PDPO (for Hong Kong SAR).

6. Security of Data

The security of your data is a priority, but no method of transmission over the Internet or electronic storage is 100% secure. We use commercially acceptable means to protect your Personal Data, including:

• SSL/TLS encryption for all data transmitted between your browser and our servers
• Secure payment processing via PCI-DSS compliant Payment Processor (Stripe)
• Limited access to Personal Data within our organization
• Regular security audits and updates

However, we cannot guarantee absolute security. Once you download the Asset to your devices, the security of that file becomes your responsibility. We recommend storing the Asset securely and not sharing it in violation of your license terms.

7. Your Rights

You have the following rights regarding your data:

• Access: Request a copy of the Personal Data we hold about you.
• Correction: Request correction of inaccurate or incomplete Personal Data.
• Deletion: Request deletion of your email address and associated purchase records, subject to legal retention requirements (e.g., tax records).
• Objection: Object to processing of your Personal Data for specific purposes (though this may prevent us from providing customer support).
• Opt-Out: Unsubscribe from any marketing communications (if you opted in). Transactional emails (e.g. purchase confirmations) cannot be opted out of.

8. Third-Party Services

The Site integrates with third-party services to provide its functionality:

• Payment Processor (Stripe): Processes all payments for Asset purchases. Stripe collects payment information (credit card details, billing address) and processes transactions securely. Their privacy policy is available at https://stripe.com/privacy. Stripe is PCI-DSS compliant and handles payment data according to industry standards.
• Email Service Provider: Delivers transactional emails (e.g. purchase confirmations) on our behalf. They have access to your email address solely for this purpose.
• Analytics Provider: May be used to collect anonymized Usage Data for Site improvement. No personally identifiable information is shared with analytics providers.

These third parties have access to your data only to perform their services on our behalf and are contractually obligated not to disclose or use it for other purposes. We are not responsible for their data practices, and you should review their respective privacy policies.

9. International Customers and Data Protection Laws

HighSyntax operates from Hong Kong SAR and processes data in accordance with the Personal Data (Privacy) Ordinance (PDPO). However, we serve customers globally and respect international data protection standards:

• EU/UK Customers (GDPR/UK GDPR): We comply with GDPR requirements for lawful processing, data subject rights, and secure data transfers. Your legal basis for processing is contractual necessity (to fulfill your Asset purchase) and legitimate interest (to improve the Site).
• California Residents (CCPA): You have rights to know what Personal Data is collected, request deletion, and opt-out of sales (note: we do not sell Personal Data).
• Other Jurisdictions: We strive to meet local data protection standards and will comply with lawful requests from authorities.

10. Children's Privacy

The Site and Asset are intended for professional use by real estate agents, brokers, and marketing professionals. We do not knowingly collect Personal Data from individuals under the age of 18.
